Immigration and Refugee Review Tribunal

Of the tens of thousands of people who apply to immigrate to Australia each and every year, there is only a small to medium percentage of those who are successful. Although many unsuccessful applicants either don’t mind too much or revise their application from overseas and try again, there are still thousands who depend on acceptance by Australian immigration to be allowed to stay in the country as an immigrant or refugee. Depending on each individual’s circumstances, rejection of refugee or immigrant status to Australia can lead to devastating results. Some have no home to return to or fear terrible conditions or persecution in their homeland.

Of course, being a fair country with a just immigration system, failed applicants hoping to stay in Australia are able to appeal for an immigration review tribunal and refugee review tribunal which involves a panel to look further into each case. Many are confirmed to be unsuccessful but there are also a lot which are repealed, leading to the applicants’ confirmation of immigrant or refugee status in Australia. For a successful tribunal NSW is maybe not the best or worst of the states, but certainly processes the most applications and appeals. There does not appear to be any particular state of Australia which rescinds more refusals than another, once the relative percentages have been taken into account.

Those hoping to become an Australian refugee, or to use a better term, a refugee in Australia, need to qualify in several criteria to confirm their status from their homeland and the troubles which they suffer. Although immigration Australia are often feared or disliked by many applicants, the system is fair and designed to offer the best balance to allow appropriate applicants speedy approval while rejecting those who are attempting to enter Australia for the wrong reasons or through the wrong channels.

There are not a great deal of disadvantages of appealing a rejection and asking for an immigration review tribunal and refugee review tribunal to absolutely confirm whether or not one’s status or application is acceptable to become an immigrant or refugee in Australia. However, the appeal process is lengthy and can lead to additional costs as well as delays and the possibility of a negative knock-on effect for future applications. Whatever the result of a visa or refugee applicant to stay in Australia, applicants should not lose hope of becoming a part of the Australian population on a long-term or permanent basis.
